Grounds for Detention Reviews

‘Grounds’ refers to the relevant section of the IRPA under which each detention review is founded. Please note that an individual can be detained on more than one ground and may be subject to more than one detention review depending on the length of detention.

How to read the Grounds for Detention Reviews chart

  • 58(1)(a) Danger to public: The individual is a danger to the public.
  • 58(1)(b) Flight Risk: The individual is unlikely to appear for examination, an admissibility hearing, removal from Canada, or at a proceeding that could lead to the making of a removal order by the Minister under subsection 44(2).
  • 58(1)(c) Reasonable Suspicion: The Minister is taking the necessary steps to inquire into a reasonable suspicion that the individual is inadmissible on grounds of security, violating human or international rights, serious criminality, criminality or organized criminality.
  • 58(1)(d) Identity-PC: The identity of the person concerned has not been established.
  • 58(1)(e) Identity-DFN: The identity of the designated foreign national has not been established.
